1. Introduction

Welcome to Sock Club. These Terms and Conditions govern your use of our website and subscription services. By accessing our website or subscribing to our service, you agree to be bound by these Terms and Conditions in accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) and the Consumer Protection Act 68 of 2008 (CPA).

Sock Club is a subscription-based service that delivers premium quality socks to subscribers on a monthly basis within South Africa.

2. Definitions

  • "Service" means the sock subscription service provided by Sock Club
  • "Subscriber" means any person who registers for and uses the Service
  • "Subscription" means the recurring monthly agreement to receive socks
  • "Website" means www.sockclub.co.za and all related pages

3. Subscription Terms

3.1 Registration

To subscribe to our service, you must:

  • Be at least 18 years of age or have parental consent
  • Provide accurate and complete registration information
  • Have a valid South African delivery address
  • Maintain the accuracy of your account information
3.2 Subscription Plans

We offer various subscription plans with different quantities of socks per month. All plans include:

  • Random surprise selection of premium quality socks
  • Free delivery within South Africa
  • Ability to cancel, pause, or upgrade at any time
3.3 Billing

Subscriptions are billed monthly on a recurring basis. By subscribing, you authorize us to charge your chosen payment method for the subscription fee. Payments are processed securely through Payfast, a registered South African payment gateway.

4. Products and Delivery

4.1 Product Description

Our socks are selected randomly by our team. While we guarantee premium quality materials and comfortable fit, the specific designs, colours, and patterns are a surprise element of our service. We do not accept requests for specific designs.

4.2 Delivery

Deliveries are handled through our courier partners, including Pudo locker-to-door service. Orders are typically processed within the first 10 days of each month, with delivery expected between days 11-15. Tracking information will be provided via email and SMS.

4.3 Delivery Areas

We currently deliver within South Africa only. Delivery times may vary based on your location.

5. Pricing and Payment

All prices are quoted in South African Rands (ZAR) and include VAT where applicable. We reserve the right to modify pricing with 30 days' notice to subscribers. Price changes will not affect current billing cycles.

Payment methods accepted include credit cards, debit cards, and instant EFT through Payfast.

6. Cancellation and Refunds

In accordance with the Consumer Protection Act:

  • You may cancel your subscription at any time from your account dashboard
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial months
  • If goods are defective or not as described, you are entitled to a refund within 6 months as per the CPA

7. Consumer Rights

In terms of the Consumer Protection Act 68 of 2008, you have the right to:

  • Receive goods that are of good quality and fit for purpose
  • Receive clear and accurate information about products and services
  • A cooling-off period of 5 business days for direct marketing transactions
  • Return defective goods within 6 months of delivery
  • Access to your personal information held by us

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Sock Club and is protected by South African and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Sock Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount paid by you in subscription fees during the 12 months preceding the claim.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA).

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated to subscribers via email at least 30 days before taking effect. Your continued use of the service after changes constitutes acceptance of the modified terms.
